Product Warranty Terms & Conditions

To be read in conjunction with the Artus Air Limited (AAL) Conditions of Sale prevailing at the date of contract and any related quotation or proposal(available directly from AAL).

Supplied Artus terminal units Parts Only Warranty Warranty extension to 36 months from date of delivery or the date of invoice, whichever is sooner, subject to the conditions below.

All AAL products or parts (non-consumable) supplied for installation within the UK and Europe carry a parts only warranty for non-consumable parts for a period of 12 months from the date of delivery or the date of invoice, whichever is sooner.

Products or parts installed or commissioned which do not meet AAL product installation and maintenance standards (Artus IOM) will invalidate all warranty claims.

WARRANTY IS ONLY VALID IN THE EVENT THAT:

  • In the period between delivery and commissioning, and for the duration of the warranty period,
    the product is properly protected & serviced in line with the AAL installation & maintenance manual
    provided; and
  • Adequate water quality has been maintained.

If a problem is reported and the warranty is confirmed as valid under the given installation and operating conditions, AAL will provide parts attributable to the rectification of any affected AAL equipment supplied.

Any spare part supplied by AAL under warranty will be warranted for the unexpired period of the
original parts warranty or 3 months from delivery, whichever is longer.

WARRANTY PROCEDURE

  • Warranty claims must be reported immediately on discovery directly to AAL at its registered
    address using the ‘Technical Service Request Form’, available at www.artusair.com.
  • AAL will confirm if the claim falls within the warranty period and conditions. Subject to a valid
    claim, AAL will provide parts attributable to the rectification of any affected AAL equipment
    supplied and may request the return of any faulty parts for further analysis.
  • If a problem exists on site that cannot be diagnosed by the customer or by telephone
    discussion with the Aftersales Support Team, AAL can, by separate agreement, plan for a site
    visit by an AAL engineer (or appointed person).
  • Where a site visit by AAL is requested, the customer shall issue a purchase order to cover the
    cost of one day of site attendance at the prevailing rate, being £995 + VAT at the date of this
    document but subject to change, to carry out investigations.
  • The AAL engineer (or appointed person) will investigate the issues on site and confirm
    whether the claim is a valid warranty claim or whether the apparent issue with the Artus
    product has been caused by some other event.
  • The AAL engineer (or appointed person) will continue with any work until it has been
    completed. If it is not possible to complete the work in one visit (e.g. parts required),
    subsequent visit(s) may need to be arranged.
  • If it is evident that there has been inadequate or no maintenance of the product during the
    period since commissioning, or if the warranty is otherwise excluded in AAL’s discretion, the
    warranty will be invalid, and the customer will be invoiced for the time and materials spent
  • If requested, all faulty components must be returned to AAL for analysis via the AAL engineer.
  • If a failed part is not returned or if it is evident that product failure occurred as a direct result
    of misuse or poor maintenance, AAL reserves the right to request payment in full for all work
    carried out to rectify the fault and for any such parts. Failure to pay any such reclaim will
    invalidate all further warranty.

EXCLUSIONS

Warranty may be refused for the following reasons:

  • Misapplication of product or component
  • Incorrect site installation
  • Incorrect or incomplete Pre-Commissioning Inspection Checklist
  • Inadequate storage
  • Inadequate site maintenance
  • Damage caused by mishandling
  • Any problem not of AAL’s making
  • Replaced part being returned damaged without explanation
  • Unnecessary delays incurred in return of defective component
  • Product installed outside the UK or Europe

WARRANTY EXTENSION REQUIREMENTS AND CONDITIONS

For made to order units, the standard 12-month warranty can be extended to 36 months subject to the following:

  1. Completion and submission of the ‘Artus Extended Warranty Requirements’ document.
  2. Products are installed and commissioned in line with the AAL Installation, Operation and Maintenance manual Artus IOM.
  3. For the duration of the warranty period, products are serviced and maintained in accordance with the installation, Operation and Maintenance manual.

WARRANTY RIGHT

The right to make a claim under this warranty resides with whomever the unit was sold to.

Where ownership has been passed on to another party, clear evidence of the contractual chain of ownership must be provided at the point of claim. Artus reserves the right to refuse a warranty claim if the unit is installed in a building different from that to which it was originally intended on being installed.

GENERAL

Any damage or defect identified as the result of transportation or other means mut be reported immediately as per the procedure defined above.

In line with Artus Air Limited UK Standard Conditions of Sale (Standard conditions of sale) and for the avoidance of doubt, Artus Air Ltd shall not be liable for any indirect or consequential loss or damage arising as a result of a defect.
